INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA

With regard to the implementation of the requirements of Regulation of the European Parliament and the Council (EU) No 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repealing of Directive No 95/46 / EC (General Data Protection Regulation "GDPR"), we inform you about the rules of processing your personal data and rights relating to this.

The following rules have been applied from 25 May 2018.

1.  The Administrator of your personal data is: Nofer Institute of Occupational Medicine in Łódź, ul. św. Teresy od Dzieciątka Jezus 8, 91-348 Łódź.

2.  In case of any questions concerning the overall design and scope of processing your personal data in respect of Administrator’s activities, and queries about the rights you received, please contact the Data Protection Supervisor in Nofer Institute of Occupational Medicine in Łódź available at:  iod@imp.lodz.pl.

3.  The Administrator of personal data  processes your personal data under applicable national legislation, concluded agreements, and on the basis of given authorization.

4.  Your personal data is processed in order to:
  a)  fulfil the legal duties laid on Nofer Institute of Occupational Medicine in Łódź;
  b)  perform the contracts concluded with counterparties of Nofer Institute of Occupational Medicine in Łódź;
  c)  in other cases, your personal data  is processed only on the basis of previously given authorization about the scope and for the purpose specified in the content of the agreement.

5.  With regard to the processing of data for the purposes listed in point 4, the recipients of your personal data can be:
  a)  public authorities and entities performing public tasks or entities acting on behalf of public authorities in the scope and for the purposes resulting from the generally applicable regulations;
  b)  other entities processing entrusted personal data on the basis on relevant agreements signed with Nofer Institute of Occupational Medicine in Łódź, as the Administrator.

6.  Your personal data will be retained for a period necessary for the pursuing the objectives specified
in point 4, and after expiry of this date, for the period and in the scope required by the generally applicable regulations.

7.  With regard to the processing your personal data you have the right to:
  a) access to personal data and to obtain a copy of the data;
  b) demand to rectify (correct) personal data – in case the data is incorrect or incomplete;
  c) demand to remove your personal data from (the so-called the right to be forgotten) if:
  • data is not no longer necessary for purposes for which it was collected and processed in other way;
  • you have objected to the processing of personal data;
  • you have withdrawn the consent for the processing of personal data which provides the basis for personal data processing and there is no other legal ground for this;
  • personal data is unlawfully processed;
  • personal data must be erased to fulfil the legal obligations.
  d)  require to limit the processing of personal data, if:
  • you dispute personal data accuracy;
  • the processing of data is unlawful and you object to erase the data and require in return data processing limitation;
  • the Administrator does not need the data for his/her purposes anymore, but you need it to establish a claim, adhere it, or to assert a claim;
  • you have objected to the processing of data until it is shown whether legally justified grounds on the Administrator’s side take precedence over the ground for objection.
  e)  transfer the data – if all of the following conditions are fulfilled:

  • the processing of data is carried out on the basis of an agreement concluded with you (the data subject) or on the basis of the authorization given by you (the data subject);
  • processing is carried out automatically.
  f)  object to the data – if all of  the following conditions are fulfilled:

  • external factors in your specific situation arise, where the data are processed on the basis of the task carried out in  the public interest or in a  public capacity of the Administrator;
  • data processing is necessary for the purposes arising from legitimate interests pursued by the Administrator or by a third party, except for the situations where the overriding nature of these interests would have your interests or fundamental rights and freedoms requiring the protection of personal data (in particular, when a person, whose data is related to is a child).

8.  If the  processing of data is carried out on the basis of your consent for the processing of personal data (article 6 act 1 letter a GDPR), you have the right to withdraw your consent at any time. The withdrawal does not affect the processing compliance with the law, which has been established on the basis of the consent before the consent withdrawal, in accordance with the applicable regulations.

9.  In case of unlawful processing of your personal data in Nofer Institute of Occupational Medicine in Łódź, you have the right to make a claim to the supervising authority responsible for personal data protection, i.e. The President of the Data Protection Authority.

10. If processing of personal data is carried out on the basis on the consent, providing your personal data to the Administrator is voluntary.

11.  Providing your personal data is obligatory if the prerequisite of personal data is a provision of law or an agreement concluded between the parties.

12. Your data can be processed automatically and will not be profiled.
